1. Agreement & Parties
These Terms of Service ("Terms") govern access to and use of JurisAI (the "Service"), provided by AutomationAI Solutions, a sole proprietorship owned by Francesco Calvia, Dammstrasse 24, 6055 Alpnach Dorf, Switzerland ("we", "us", "our"). By subscribing to, accessing, or using the Service, the customer — a law firm or legal professional (the "Firm", "you") — agrees to these Terms. If you use the Service on behalf of a firm, you confirm you are authorized to bind that firm.
2. The Service
JurisAI is an AI-powered voice receptionist and intake assistant. It answers inbound telephone calls, engages callers in natural conversation, captures intake information, screens and routes calls, schedules consultations, and sends notifications to the Firm. JurisAI is a communications and automation tool only.
3. No Legal Advice; No Attorney-Client Relationship
JurisAI does not provide legal advice and does not practice law. It does not, and is not intended to, create an attorney-client relationship between any caller and the Firm, or between any caller and us. The Firm remains solely responsible for all legal services, advice, conflict checks, case evaluation, engagement decisions, and client relationships. You are responsible for configuring the Service so that it does not provide legal opinions or guarantees to callers.
4. Professional Responsibility & Compliance
You are solely responsible for ensuring that your use of the Service complies with all rules and obligations applicable to your practice, including but not limited to:
- applicable rules of professional conduct and ethics;
- attorney advertising, solicitation, and client-communication rules;
- unauthorized-practice-of-law rules;
- duties of confidentiality and the preservation of privilege.
You are responsible for reviewing, approving, and supervising the AI's greeting, disclosures, intake questions, and scripts in every jurisdiction in which you practice.
5. Call Recording, Disclosure & Consent
Important: The Service may record, transcribe, and use AI to process calls. You are solely responsible for providing any legally required notice and obtaining any legally required consent for recording, monitoring, and AI handling of calls — including in "all-party" / "two-party consent" jurisdictions. You must configure the call-opening disclosure accordingly.
6. Account & Eligibility
You must provide accurate information, keep credentials secure, and are responsible for all activity under your account and authorized users. You must be able to form a binding contract.
7. Fees, Trial & Billing
Plans are billed in advance (monthly or annually) through our payment processor (Stripe). Free trials automatically convert to a paid subscription unless cancelled before the trial ends. Subscriptions renew automatically until cancelled. Usage allowances (e.g., included minutes) are set per plan; overages may apply. All fees are exclusive of applicable taxes.
8. Cancellation & Refunds
You may cancel at any time, effective at the end of the current billing period. Except where required by mandatory law, fees already paid are non-refundable and no credit is given for partial periods or unused minutes.
9. Acceptable Use
You will not use the Service unlawfully, to harass or deceive, to violate telemarketing or anti-robocall laws (e.g., the U.S. TCPA and analogous laws), to resell the Service without authorization, or to reverse engineer, disrupt, or misuse it. You are responsible for the lawfulness of any outbound or automated communications you configure.
10. Customer Data & License
You retain ownership of your data and of caller data processed through the Service. You grant us a limited, non-exclusive license to host and process such data solely to provide, secure, and support the Service. Our processing of personal data is described in the Privacy Policy and, where applicable, a Data Processing Agreement (DPA) available on request.
11. Our Intellectual Property
The Service, including software, models, configurations, and branding, is and remains our property or that of our licensors. We grant you a limited, revocable, non-transferable license to use the Service during your subscription.
12. Third-Party Services
The Service relies on third-party providers, including Retell AI (voice AI), Twilio (telephony), Stripe (payments), Cal.com (scheduling), and cloud hosting and language-model providers. We are not responsible for their availability, acts, or omissions, and their terms may apply to the relevant features.
13. Availability & AI Limitations
The Service is provided on a commercially reasonable basis. We do not guarantee uninterrupted or error-free operation, and maintenance or outages may occur. As an AI system, the Service may occasionally misunderstand callers, mishear information, or make errors; you are responsible for reviewing captured intake before relying on it.
14. No Guarantee of Results
We make no guarantee regarding the number or quality of calls answered, leads, consultations booked, conversions, or revenue. Any figures or examples shown on our website are illustrative only.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
16. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages, nor for lost profits, lost data, or any missed, delayed, or mishandled calls. Our total aggregate liability for any claim shall not exceed the fees you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and costs arising out of your use of the Service, your scripts and content, your callers' data, recording without required consent, or your violation of any law or professional rule.
18. Confidentiality
Each party will protect the other's confidential information and use it only as needed to perform under these Terms.
19. Term & Termination
We may suspend or terminate the Service for breach, non-payment, or unlawful use. You may cancel under Section 8. On termination, your access ends and data is handled as described in the Privacy Policy and any applicable DPA.
20. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by reasonable means; continued use after changes take effect constitutes acceptance.
21. Governing Law & Jurisdiction
These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the CISG. To the extent permitted by mandatory law, the exclusive place of jurisdiction is the competent courts of the Canton of Obwalden, Switzerland. Mandatory protections available to you in your place of residence remain unaffected.
